RESOLUTION DIRECTING THE COMMITTEE ON HUMAN RIGHTS TO CONDUCT AN INQUIRY, IN AID OF LEGISLATION, ON THE FORCIBLE EVACUATION OF 1,740 PEASANTS ON APRIL 1, 2019 IN BARANGAY QUINTIN REMO IN MOISES PADILLA TOWN, NEGROS OCCIDENTAL DUE TO MASSIVE MILITARY OPERATIONS AND ARBITRARY ARREST OF ELEVEN (11) “SAKADA” OR FARMWORKERS IN BARANGAY SEBUCAUAN, ISABELA TOWN, BY ELEMENTS OF THE ARMED FORCES OF THE PHILIPPINES AND PHILIPPINE NATIONAL POLICE

WHEREAS, on April 1, 2019, 1,740 peasants from Sitios Santos-Santos, Lomlom and Upper Mamballo in Barangay Quintin Remo in Moises Padilla town, Negros Occidental forcibly evacuated their communities due to massive military operations being carried out by the 62nd Infantry Battalion of the Philippine Army and units of the Philippine National Police and eleven (11) “sakada” or farmworkers, including two minors, were arrested in Barangay Sebucauan, Isabela town, based on various news reports;

WHEREAS, the Stand With Guihulngan Movement, a group demanding justice for killed victims of police and military , said that the military operations were as reprisal to the presence of the New People’s Army (NPA) and the arrested farmworkers are being charged with the murder of Moises Padilla councilor Jolomar Hilario, amid, admission by the NPA of responsibility;

WHEREAS, the arrested farmworkers are:

1. Junior Amparado;

2. Junrell Gador;

3. Jomar Pablo;

4. Raymond Gabitanan;

5. Ruel Sarillo;

6. Jason Abria;

7. Joenel Sebugan;

8. Richard Sarillo;

9. Christian Sarillo;

10. Denmar Recto, a minor;

11. Reneboy Estorco, a minor;

WHEREAS, the peasant evacuees fled to Barangay Quintin Remo proper, Barangays Montilla and Guinpanaan and the town proper;

WHEREAS, on April 2, 2019, the arrested farmworkers were brought to the Hall of Justice in Bacolod City, wearing bonnets;

WHEREAS, on April 6, 2019, the arrested minors, Denmar Recto and Reneboy Estorco, were released;

WHEREAS, Bagong Alyansang Makabayan – Negros (Bayan), National Federation of Sugar Workers (NFSW), Unyon ng Manggagawa Agrikultura (UMA), Amihan National Federation of Peasant Women, Kilusang Magbubukid ng Pilipinas (KMP), Stand for Guihulngan and Justice for SEMPO Victims condemned the arbitrary arrest of eleven farmworkers and demanded their immediate and unconditional release, and the stop to massive militarization of peasant communities;

NOW, THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, that the Committee on Human Rights conduct an inquiry, in aid of legislation, on the forcible evacuation of 1,740 peasants on April 1, 2019 in Brgy. Quintin Remo in Moises Padilla town, Negros Occidental and arbitrary arrest of 11 farmworkers in Brgy. Sebucauan, Isabela town, by elements of the AFP and PNP.
