RESOLUTION
DIRECTING THE COMMITTEE ON LABOR AND EMPLOYMENT AND HUMAN RIGHTS TO CONDUCT A JOINT INQUIRY, IN AID OF LEGISLATION, ON THE
EXTRA-JUDICIAL KILLING OF DANNY BOY BAUTISTA, AGRICULTURAL WORKER OF SUMITOMO FRUITS (SUMIFRU) AND THE CONTINUING VIOLENT ATTACKS AGAINST OTHER UNION MEMBERS UNDER THE
NAGKAHIUSANG MAMUMUO SA SUYAPA FARM (NAMASUFA)
IN COMPOSTELA VALLEY PROVINCE

WHEREAS, a victim of extra-judicial killing, Danny Boy Bautista was an active member of the Nagkahiusang Mamumuo sa Suyapa Farm (NAMASUFA). Bautista is a harvester for five years of Packing Plant 340 of Sumitomo Fruits Philippines (Sumifru). On October 31, around 6:00 PM, unidentified armed assailants shot Bautista in Barangay Poblacion, Compostela town, Compostela Valley;

WHEREAS, prior to the killing, Bautista actively participated in NAMASUFA workers’ strike which was launched on October 1, 2018, in eight packing plants of Sumifru in Compostela town and during the violent dispersal by the elements of Philippine National Police and Armed Forces of the Philippines of the picketline on October 11, 2018. According to NAMASUFA Union President Paul John Dizon, the victim served as one of the marshals of the union strike and joined the massive protests of farmers, workers and indigenous peoples in October demanding the end of martial law in Mindanao;

WHEREAS, prior to the extra-judicial killing of Bautista, members of NAMASUFA fell victim to violent attacks, frustrated and attempted killings:

• August 20, 2018 – Melodina Gumanoy, member of NAMASUFA noticed motorcycle-riding men following her on way to work at Packing Plant 250 in Brgy. Osmeńa, Compostela town, was able to evade them by hiding inside a nearby house
• September 4, 2018 – Victor Ageas, NAMASUFA Board of Director, working in Packing Plant 340 in Brgy. Brgy. Osmeńa of the same town, was shot six times by unidentified perpetrators but survived, a day after their protest against Sumifru and demanding regularization of workers and wage increases;
• November 12, 2018 – Jerry Alicante, member of NAMASUFA working at Packing Plant 220 was shot by unidentified perpetrators outside his house at Brgy. Osmeńa of the same town, but survived, sustaining two gunshot wounds;
• December 15, 2018 – the houses of NAMASUFA President Paul John Dizon and leader Vicente Barrios, and the NAMASUFA Union Office near the Packing Plant 220 was burned down, early morning;

WHEREAS, workers of NAMASUFA asserted that the continuing violent attacks against them are retaliation for their struggle for regularization of work and wage increases. Even so, they remain unwavering to advance their legitimate demands, thus, their caravan and camp-out in the National Capital Region since November last year, to press on the Department of Labor and Employment (DOLE) and Office of the President to implement the regularization of workers and increase in wages;

NOW, THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, directing the Committees on Labor and Employment and Human Rights to conduct a joint inquiry, in aid of legislation, on the extra-judicial killing of Danny Boy Bautista, agricultural worker of Sumifru and the continuing violent attacks against union members of NAMASUFA in Compostela Valley province.
