RESOLUTION
DIRECTING THE COMMITTEES ON AGRARIAN REFORM, NATURAL RESOURCES AND HUMAN RIGHTS, TO CONDUCT A JOINT INQUIRY, IN AID OF LEGISLATION, ON THE FILING OF TRUMPED-UP CHARGE AGAINST TWENTY FIVE FARMERS OF BRGY. MAOANAN, RIZAL, CAGAYAN AS PART OF LAND GRABBING AND MEANS TO DISPLACE THEM FROM THEIR FARMS

WHEREAS, farmers under the Nagkaykaysa a Mannalon a Maag-agawan ti Daga, a local chapter of Danggayan dagiti Mannalon ti Cagayan Valley (DANGGAYAN-Cagayan Valley), the regional organization of the Kilusang Magbubukid ng Pilipinas (KMP) have been cultivating the lands located in Brgy. Maonan, Rizal town in Cagayan province since 1990;

WHEREAS, in 1991, a certain Fidel Villafor, whose father, Atty. Nelson Villafor, a sudden claimant, filed a petition to the Department of Environment and Natural Resources (DENR) to re-classify the 70- hectares lands that contains the victims’ farmlands, into a pasture land, which the said office approved in 1993 without due process and considering the welfare of the farmers;

WHEREAS, despite the re-classification, the farmers asserted their rights to land and continued cultivation;

WHEREAS, on the same year, Rolando Guevarra, son-in-law of Fidel Villafor filed another petition to the DENR to re-classify another 20-hectares of lands for pasture use;

WHEREAS, in 1999, the claimant Atty. Villaflor, managed the pasture land and demanded the eviction of farmers;

WHEREAS, after two incidents of attempted eviction, the farmers sought dialogue with the City Environment and Natural Resources Office (CENRO) in Solano, Cagayan who favored the farmers and told them to remain on lands;

WHEREAS, Atty. Villaflor confronted the farmers and attempted seven times to evict them, of which the worst were on May 6 and 13, 2017, when the land grabber hired men dismantle the farmers’ fences and portions of their houses;

WHEREAS, as the eviction and land grabbing attempts were fervently foiled by the farmers, they unsuspectingly received subpoenas from the Provincial Prosecutors Office of Tuguegarao, Cagayan on charges of frustrated murder filed by a certain Carmelo Favor against the twenty five farmers;

WHEREAS, as the plight of farmers in Brgy. Maoanan is templative of land grabbing and displacement schemes of landlords in the country, that clearly violates the farmers’ rights to land and their basic rights, this resolution is filed;

NOW, THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, that the Committees on Agrarian Reform, Natural Resources and Human Rights to conduct a joint inquiry, in aid of legislation, on the filing of trumped-up charge against twenty farmers of Brgy. Maoanan, Rizal, Cagayan Valley as part of land grabbing and means to displace them from their farms.
