RESOLUTION
DIRECTING THE COMMITTEE ON HUMAN RIGHTS TO CONDUCT AN INVESTIGATION, IN AID OF LEGISLATION, ON THE EXTRA- JUDICIAL KILLING OF PEASANT ACTIVIST JASON MONTALLA, AN ACTIVE MEMBER OF MAG-UUMA NA NAGKAHIUSA (MANA) BY ALLEGED ELEMENTS OF THE 78TH INFANTRY BATTALION OF THE PHILIPPINE ARMY (IBPA) IN ALBUERA TOWN, LEYTE

WHEREAS, peasant activist Jason Montalla, 33 years old, and an active member of Mag-uuma na Nagkahiusa (MANA), a local organization Samahan han Gudti nga Parag-uma ha Sinirangan Bisayas (SAGUPA – SB), the regional chapter of Kilusang Magbubukid ng Pilipinas (KMP), was shot on his left torso by unidentified men in Albuera town, Leyte last September 5, 2017 and was hospitalized until his death last September 21;

WHEREAS, prior to his death, the victim was able to inform SAGUPA – SB of the circumstances during the shooting incident:

· on September 5, after the victim had dinner with his family in Albuera public market, he rode his bicycle towards home and he observed that a person was gazing at him, but he simply ignored it;

· upon reaching San Andres street, unidentified men riding-in-tandem on a motorcycle barred his path, the driver was wearing a helmet while the other man had his face covered;

· shrouded in fear, he shouted, “huwag niyo po akong sasaktan at ako ay dadaan lang,” but the perpetrators ignored his plea and shot him at his left torso;

· surviving the attack but seriously wounded, he speedily rode his bicycle towards a police station, and nearing it, he was shot upon several times and he was hit on his left hand and he screamed for help until reaching the station;

· inside the police station, instead of hunting down the perpetrators, elements of police pointed their firearms at the victim;

WHEREAS, SAGUPA – SB blamed the police for the perpetrators’ escape as they responded sluggishly and indecisively;

WHEREAS, the group asserted that the attack was political as he was a victim of red-baiting by the Philippine Army, as indicated by the following circumstances:

· the victim was accused of being a supporter of the New People’s Army (NPA) and the Philippine Army claimed that he was seen at the encounter between soldiers and members of the NPA at Sitio Batog, Brgy. Canlalin, Albuera, Leyte last February 7, 2017;

· a certain Pepito of the 78th IBPA visited Montalla’s house twice and accused him as a supporter of the NPA;

· in April 2017, Montalla’s brother, Jumar Alao became a military asset and warned him that he would be killed someday; Jumar was recruited by a certain Pepito after the encounter in February 2017;

WHEREAS, SAGUPA – SB asserted that the victim was not a member of the NPA, but an active member of the peasant group MANA, in advancing the rights to land of its members;

WHEREAS, the victim’s death is an addition to the increasing number of farmer-victims of extra-judicial killings under the Duterte presidency and it remains unabated, hence, it is urgent for congress, as part of its mandate and for the protection of human rights in the country, to hold an inquiry;

NOW THEREFORE BE IT RESOLVED, AS IT HEREBY RESOLVED, that the Committee on Human Rights to conduct an investigation, in aid of legislation, on the Extra-judicial killing of peasant activist Jason Montalla, an active member of MANA by alleged elements of the 78th IBPA in Albuera town, Leyte.
