RESOLUTION
DIRECTING THE COMMITTEE ON HUMAN RIGHTS
TO CONDUCT AN INQUIRY, IN AID OF LEGISLATION,
ON THE ILLEGAL ARREST AND FILING OF TRUMPED UP CHARGES AGAINST MEMBERS OF THE COMPOSTELA FARMERS ASSOCIATION (CFA) IN BRGY. MANGAYON, COMPOSTELA TOWN, COMPOSTELA VALLEY BY ELEMENTS OF THE 66th INFANTRY BATTALION PHILIPPINE ARMY (IBPA)

WHEREAS, on 2pm of July 2, 2017, Compostela Farmers Association (CFA) leader and members, Alicia Tindasan, Jhona Rose Baugto, Estanislao Talledo and Rolan Segovia supposed to attend a barangay-wide assembly of a CFA-affiliated local peasant organization in Purok 4B, Brgy, Mangayon, Compostela town, Compostela Valley and at the same time, visit a lumad school in the area, also arrested was the driver of the “habal-habal” they rode on;

WHEREAS, before reaching the said venue of the activity, they were waylaid by eight soldiers under the 66th IBPA, after a few minutes, another batch of soldiers numbering to seven arrived;

WHEREAS, according to Karapatan – Southern Mindanao Region (Karapatan SMR), based on Alicia Tindasan’s statement, the next batch of soldiers arrived brought a sack of containing rice, and she asserted that there were some explosives within;

WHEREAS, the soldiers of the 66th IBPA the later brought the victims to the Compostela Municipal Police Station for detention, after a certain Lt. Noas endorsed them to the local police and were charged of illegal possession of explosives;

WHEREAS, CFA farmers, since before the declaration the Proclamation No. 216 placing the whole Mindanao on martial law, experienced various kinds of harassments, vilification and even cases of extra-judicial killing among its members:

· October 10, 2016, Brgy. Ngan, Compostela, Jimmy Saypan, Secretary-General of CFA, killed;

· March 2, 2017, Brgy. Osmeña, Compostela, farmer couple Leonila and Ramon Pesadilla, both active members of CFA, provincial chapter of Kilusang Magbubukid ng Pilipinas (KMP) and member of Anakpawis Party-list, were killed;

· February 16, 2017, Pantukan, Edwin Catog, leader of Hugpong sa Mag-Uuma sa Walog Compostela (Humawac) farmers’ group in Compostela Valley, killed;

· May 3, 2017, Maragusan, Federico Plaza, local leader of Humawac, killed;

· May 31, 2017, Laak, farmer couple Kidjol Marcelo Antay Sr. and his wife Noeme, Kidjol Marcelo is a local leader of Nagkahiusang Mag-uuma sa Laak, illegal arrest by soldiers belonging to 60th IBPA and para-miliary group Magahat-Bagani;

· June 27, 2017, Brgy. LS Sarmiento, Laak, Gimmy Adlin, Romar Ruales, Kagawad Junrex Mission and Mendoy Tonlay, members of Pederasyon sa mga Asosasyong Mag-uuma ug Lumad sa Agusan ug Davao (Pamulad), illegal arrest by soldiers of 60th IBPA and CAFGU Civilian Auxiliaries;

WHEREAS, abuses against farmers have been incessant as rural communities in Compostela Valley province have been subjected to massive militarization since the past administration, where the Armed Forces of the Philippines (AFP) has been implementing the counter-insurgency program Oplan Bayanihan and at the start of 2017, Oplan Kapayapaan;

WHEREAS, the declaration of martial law in Mindanao, facilitated the intensified military operations in farmer communities and illegal arrest and other form of abuses have been a standard-operation procedure (SOP) for elements of the AFP against peasant activists who are resisting mining operations and other projects that will lead to their displacement from land;

WHEREAS, the victims being marginalized and victims of state repression, the authors of this resolution is morally obligated to press their issue in congress, in light of the preservation of democratic rule and prevention of authoritarianism and fascism in the country;

NOW, THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, that the Committee on Human Rights to conduct an inquiry, in aid of legislation, on the illegal arrest and filing of trumped up charges against members of the Compostela Farmers Association in Brgy. Mangayon, Compostela town, Compostela Valley by elements of the 66th IBPA.
